Privacy Policy Notice
MathPath, LLC ("MathPath") takes the privacy of our users very seriously; therefore, we only collect information necessary to provide our services effectively. We understand that our users care about how their information is used and shared, and we appreciate our users' trust that we will be careful and sensible with their information. This notice describes our privacy policy. By accessing www.mathpath.org (our "Website") and any of our Services, users are accepting the practices described in this Privacy Policy Notice. This Policy does not apply to the practices of companies that we do not own or to individuals that we do not employ or manage.
Privacy of Children & Collection of Information
MathPath provides additional privacy protections when children visit our Website. We do not knowingly collect, maintain, or store personal information from or about children under the age of 13 without a parent's and/or legal guardian's consent, except in limited circumstances authorized by law and described in this notice. Users under the age of 18 should read this privacy policy with a parent and/or legal guardian. MathPath must have a parent's and/or legal guardian's consent before collecting any personal information of users under the age of 13.
Information collected from children consists of student roster data including name, home mailing address, age & birthday, e-mail address, phone number, grade level, school information, and short-answer information regarding interests, extra-curricular activities, and math experiences. MathPath uses a Google for Nonprofits™ account to collect and store information. In the case of a Remote program, users may participate in virtual classes and activities through different websites and platforms that are not owned or operated by MathPath. The most common platforms that users may access through MathPath are ZOOM (Zoom Video Communications, Inc.), and Google. This information, which may be shared with teachers, counselors, assistants and administrators who are all independent contractors, employees, or volunteers of MathPath ("Staff"), is used to help students participate in MathPath activities, notify students and their parents and/or guardians of information and opportunities, and otherwise further the educational enrichment mission and objectives of MathPath. MathPath does not require a child to disclose more personal information than is reasonable and necessary to participate in MathPath activities.
MathPath does not disclose information collected from children to unaffiliated third parties.
MathPath will use the "e-mail plus" method to confirm consent; a parent/guardian must reply to a message sent from MathPath to confirm consent to collect personal information about their child. Parents and/or legal guardians may review personal information MathPath has collected about their child, request deletion or refuse to allow further collection or use of the information. Use of Collected Information
To make our Website and our Services available to users, or to meet a legal obligation, MathPath needs to collect and use certain Personal Information. If users do not provide the information that we request, we may not be able to provide them with requested products or services. Any information collected from users may be used for the following purposes:
- Evaluate qualifications and make decision regarding admission and/or hiring
- Send administrative information and other communications
- Run and operate the Website and Services
- Respond to inquiries and offer support
- Enforce terms and conditions and policies
- Create and manage user accounts
Retention of Information
MathPath will retain and use all Personal Information collected for the period necessary to comply with our legal obligations, resolve disputes, and enforce our agreements unless a longer retention period is required or permitted by law. MathPath may be required to retain Personal Information by federal or state laws. MathPath may retain an archival copy of Personal Information after it has been updated or requested to be removed from current records. MathPath may use aggregated data derived from or incorporating Personal Information after it has been updated or deleted, but not in a manner that would identify the user personally. The right to access, erasure, rectification, and data portability cannot be enforced after the expiration of the retention period.
We receive and store any information users enter on our Website or give us in any other way. Such information includes name, home mailing address, birthdate, e-mail addresses, phone numbers, school information, grade level, and other information regarding extra-curricular activities, interests, and math/academic experience, and any other materials users willingly submit such as images, feedback, etc.
Sharing Information
MathPath uses a Google for Nonprofits™ account to collect and store information.
To protect MathPath and Others, MathPath will release any personal information when we believe release is appropriate to comply with the law; enforce or apply contractual agreements; or protect the rights, property, or safety of MathPath, our users, or others. This use does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from students and parents/guardians for commercial purposes in violation of the commitments set forth in this Privacy Policy Notice.
Other than as set out above, users will receive notice when their information might be given to third parties and will have the opportunity to choose not to share information.
User Rights
Users may exercise certain rights regarding their Personal Information obtained and processed by MathPath. Users have the right to:
- Withdraw consent where it has previously been given to the processing of their Personal Information
- Learn if information is being processed by MathPath, obtain disclosure regarding certain aspects of the processing and obtain a copy of the information undergoing processing
- Verify the accuracy of their information and ask for it to be updated or corrected
- Under certain circumstances, restrict the processing of their information, in which case, MathPath will not process information for any purpose other than storing it
- Under certain circumstances, obtain the erasure of their Personal Information
- Receive their information in a structured, commonly used and machine readable format
Users in the EU
A user who is a resident of the European Economic Area (EEA) has certain data protection rights. MathPath takes reasonable steps to allow such users to correct, amend, delete, or limit the use of their Personal Information. Such users who wish to be informed what Personal Information is being held (or to request its removal from our systems) should contact us at webmaster@mathpath.org. In certain circumstances, such users have the following rights:
- To request access to their Personal Information that we store and have the ability to access it
- To request that we correct or complete any of their Personal Information the user believes is inaccurate or incomplete
- To request that we erase their Personal Information under certain conditions of this Policy
- To object to the processing of their Personal Information
- To seek restrictions on the processing of their Personal Information. In this case, MathPath may store the information, but not process it further
- To be provided with a copy of the information MathPath has about them in a structured, machine-readable and commonly used format
- To withdraw consent at any time where MathPath relied on consent to process Personal Information

Exercising User Rights
Any requests to exercise user rights can be directed to MathPath via email at webmaster@mathpath.org or via postal mail to MathPath, ATTN: Webmaster; 32 Clyde Rd, Unit 1; Watertown, MA 02472. MathPath will require users to verify identity before responding to such requests. Requests must provide sufficient information that allows MathPath to verify that the request is coming from a User or a User's authorized representative. Requests must include sufficient details to allow MathPath to properly understand the request and respond to it. MathPath cannot respond to a request or provide Personal Information unless we first verify the requester's identity or authority.
Users can always choose not to provide information, even though it might be needed to take advantage of certain MathPath Services. Users who do not want to receive e-mail or other mail from us should follow the instructions provided on those communications for making us aware of that decision.
Links to Other Resources
The Website and Services may contain links to other resources that are not owned or controlled by MathPath. Please be aware that MathPath is not responsible for the privacy practices of such other resources or third parties. We encourage users to be aware when they leave our Website and to read the privacy statements of each and every resource that may collect Personal Information.
Information Security
MathPath secures information on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. MathPath maintains reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of Personal Information in its control and custody. However, no data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect users' Personal Information, users acknowledge that (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity, and privacy of any and all information and data exchanged between them and the Website and Services cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third party, despite best efforts.
Data Breach
In the event MathPath becomes aware that the security of the Website and Services has been compromised or users' Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the user as a result of the breach or if notice is otherwise required by law. When we do, we will post a notice on the Website, send affected users an email, and/or mail affected users a letter.
Conditions of Use, Notices, Changes or Amendments
MathPath reserves the right to modify this Policy or its terms relating to the Website and Services from time to time in our discretion and will notify users of any material changes to the way in which we treat Personal Information. When we do, we will revise the updated date at the bottom of this page. We may also provide notice to users in other ways at our discretion, such as through contact information they have provided. Any updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. Users' continued use of the Website and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute consent to those changes.
Unless stated otherwise, our current Privacy Policy Notice applies to all information that we have about current and past users. We will never materially change our policies and practices to make them less protective of student and parent/guardian information collected in the past without the consent of affected students and parents/guardians.
By accessing and using the Website and Services users acknowledge that they agree to all terms and conditions in this Policy and agree to be bound by this Policy. Users who do not agree to abide by the terms of this Policy are not authorized to access or use the Website and Services. Use of this website and any disputes over privacy are subject to this Notice and our Conditions of Use, including limitations on damages, resolution of disputes, and application of the law of the state of Michigan.
